Agent agrees to drop claim that ‘only’ it could get sellers highest possible price

Three more complaints against agents have been informally resolved by the Advertising Standards Authority.

One complaint was about a circular distributed by a RE/MAX agent which said that “only” that firm “will get you the highest possible price”.

A complainant challenged whether the claim was misleading and could be substantiated.

The advertiser said the claim would not be used again.

In a second case, Sheffield agency Happy Sales and Lettings listed a number of its competitors’ sold and unsold properties in a leaflet.

Competitor Crucible Sales and Lettings challenged whether the comparison table was misleading, and whether the comparison was verifiable.

A spokesperson for the ASA said: “We approached the advertiser.

“The ad was no longer appearing but the advertiser provided assurances that it would ensure they based comparisons on objective criteria and presented them in a way that is unlikely to mislead; clearly signpost where consumers can get the information they need to verify a claim; and ensure that information is able to be accessed easily by consumers so they are able to check the comparison for themselves.”

A third complaint was about a circular claiming that Lewis Gray, in Frome, Somerset, was on Zoopla.

The complainant said this was misleading.

Lewis Gray said it had stopped using Zoopla and the circular had been discontinued. The firm had removed all the references from its marketing and website.
